[ARCHIVED] NOTICE OF DEVELOPMENT


A Development Permit has been approved to grant a variance for a residential high density development.  The development includes the variance as noted below.

Location:  4101 – 50 Street

Legal description of this address:  Lot D, Block 3, Plan 782 0767

Land Use Bylaw:  RHD1 – Residential High Density 1 District


Variances and/or Discretionary Use

Section numbers below refer to Land Use Bylaw 796-12.

  1. Variance to Section 8.7.4 – allowing three (3) Accessory Buildings/Garages to exceed the 5.0m maximum height requirement by 0.30m (1 ft.)

Appeals

Persons may appeal the decision to the Subdivision and Development Appeal Board (SDAB) within 21 days of being notified. Development will continue if no appeals have been filed. The SDAB is an independent body established by Town Council.  Its decisions are final and can only be overturned by the Courts if the Board makes an error of law or jurisdiction.

Notification Appeal Period:  March 9, 2018, to March 30, 2018

To file an appeal or get information on the appeal process you must contact the Secretary of the SDAB directly (contact information noted below), by 4:30 pm no later than March 30, 2018.  The appeal fee is $55.00.
