Active Planning & Development The purpose of notice is to advise to the selling of municipal land, previously designated as municipal reserve, for less than market value. In accordance with Sections 70, 606 and 674 of the Municipal Government Act, RSA 2000, c M-26 (the “MGA”), the City of Beaumont proposes to sell City-owned land at Lot 14 (previously Lot 14MR), Block 5, Plan 192 0707 in Beaumont for $600,000. As of March 26, 2025, the parcel of land for sale was appraised at $740,000. The appraisal report included an Extraordinary Assumption, which is an assumption, that if not true, could alter the appraiser’s opinion and conclusion. As per the appraisal report, the following Extraordinary Assumption was invoked: “Vehicular access to the subject site is currently not possible. At the request of the client, we [appraisers] have assumed that vehicular access to the subject property is possible via 30th Avenue or Magasin Avenue. The inclusion of this Hypothetical Condition required the invocation of an Extraordinary Assumption. Should access fail to be provided from either 30th Avenue or Magasin Avenue, then this appraisal would be voided.” As per the City’s Parks and Facilities Master Plan, Our Places and Play, the City-owned land is not of an adequate size to accommodate and maintain an open space or park. Additionally, the parcel is not directly accessible from a roadway by a vehicle, which limits the City’s ability to maintain the parcel with certain types of equipment. If the lands directly north and adjacent to the City lands are developed, the City’s maintenance efforts will be restricted to only the designated pathway which may not be able to accommodate the weight and width of the necessary equipment. For these reasons, the City proposes to sell the land to a developer for residential development. Petitions Petitions against the City’s proposal to sell land may be filed with: The City Clerk Office at City Hall, 5600 49 Street, during business hours, or emailed to Legislative@beaumont.ab.ca; beginning on July 12, 2025, and not later than September 9, 2025. Please note that while the petition period begins on Saturday, July 12, City Hall is closed on weekends, so in-person submissions can only be made on weekdays during business hours. Petitions must comply with the requirements of Part 7 of the MGA, and specifically section 224, which provides that petitions must: contain on each page an identical statement of the purpose for the petition be signed by petitioners who are electors of The City of Beaumont, equal in number to at least 10% of the population; and contain for each petitioner: printed surname and given names of initials of the petitioner; petitioner’s signature; street address or legal description of the land where the petitioner lives; the petitioner’s telephone number or email address, if any; and the date on which the petitioner signed the petition; and every petitioner’s signature must be witnessed by an adult person who: signs opposite the petitioner’s signature; swears an affidavit confirming that to the best of the witness’s knowledge the signatures are those of the persons entitled to sign the petition, and such affidavits must be attached to the petition; and a signed statement of an individual who is the representative of the petitioners to whom the municipality may direct any inquiries about the petition. If a sufficient petition is not filed by September 9, 2025, the City may pass a resolution to sell the land as provided in its resolution for less than market value without further notice. The proposed resolution is scheduled for the September 16 regular council meeting.
